The Work Injury Compensation Act (WICA) allows employees to make claims for work-related injuries without having to file a civil suit under common law. WICA covers accidents arising out of and in the course of employment. Employees may make a claim under WICA in the following scenarios:
- Injured by an accident arising out of and in the course of employment
- Injured while on an overseas assignment
- Contracted an Occupational Disease
- Contracted a disease from exposure to biological or chemical agents at work
This area of practice involves the following:
- Advising clients on pursuing their claims through the Ministry of Manpower under WICA instead of under common law
- Examining medical reports and accident reports
- Assisting clients in their claim for medical leave wages, medical expenses and lump sum compensation (for permanent incapacity or death) in instances where they are injured in the course of their employment
- Negotiating settlement
